The only cost to be borne by the Customer in connection with withdrawal from the Contract shall be the cost of returning the goods. The goods must be returned to the supplier no later than 14 days from the date of the cancellation notice.  <\/p>\n<p>In order to exercise the right of withdrawal, the Client must inform the Tenderer ARTINA, Tina Djilas s.p., Kri\u0161ka vas 58, 1294 Vi\u0161nja Gora, telephone 040 828 681, e-mail <a class=\"cursor-init\" href=\"mailto:tina@artina.si\">tina@artina.si<\/a>, of its decision to withdraw from this Contract by an unequivocal statement (e.g. by letter sent by post or e-mail). For this purpose, the Client may optionally use a withdrawal form. For the withdrawal period to be respected, it shall be sufficient that the notification concerning the exercise of the Customer&#8217;s right of withdrawal is sent before the expiry of the withdrawal period from this Contract.  <\/p>\n<p>Returned goods must be unused, undamaged and in their original and undamaged packaging. Liability for material defects[\/vc_custom_heading][vc_column_text uncode_shortcode_id=&#8221;138525&#8243;]The Supplier shall deliver the Goods to the Customer in accordance with the Contract and shall be liable for material defects in its performance. A defect is material: <\/p>\n<ol>\n<li>if the product does not have the characteristics necessary for its normal use,<\/li>\n<li>if the product does not have the characteristics required for the specific use for which the customer is buying it, which were known or should have been known to the supplier,<\/li>\n<li>if the product does not have the characteristics and qualities that were expressly or tacitly agreed or prescribed,<\/li>\n<li>if the supplier has handed over an item that does not match the image in the online shop, unless the image was displayed for notification purposes only.<\/li>\n<\/ol>\n<p>The suitability of the goods for normal use shall be assessed in relation to normal goods of the same type and taking into account any statements made by the supplier or the manufacturer about the characteristics of the goods, in particular by means of advertising, product presentation or claims made on the goods themselves.<\/p>\n<p>Liability for material defects is governed by the provisions of the law governing contractual relations, unless otherwise provided for in this Law.<\/p>\n<p class=\"Odstavek\">The Customer may exercise its rights under the material defect if it notifies the Supplier of the defect <strong>within two months<\/strong> of the date on which the defect was discovered. The contracting authority must describe the defect in more detail in the defect notification and give the tenderer an opportunity to inspect the defect. The defect notification may be given by the Customer to the supplier in person, with a receipt from the supplier, or by sending it to the shop where the product was purchased.  <\/p>\n<p class=\"Odstavek\">The contracting authority which has duly notified the tenderer of the defect shall be entitled to require the tenderer to:<\/p>\n<ul>\n<li class=\"Alineazaodstavkom\"><span lang=\"X-NONE\">rectify a defect in the product; or<\/span><\/li>\n<li class=\"Alineazaodstavkom\"><span lang=\"X-NONE\">refund a proportion of the amount paid in proportion to the defect; or<\/span><\/li>\n<li class=\"Alineazaodstavkom\"><span lang=\"X-NONE\">replace the defective product with a new, faultless product; or<\/span><\/li>\n<li class=\"Alineazaodstavkom\"><span lang=\"X-NONE\">refund the amount paid.<\/span><\/li>\n<\/ul>\n<p class=\"Odstavek\">In any event, the Customer shall also have the right to claim from the Seller compensation for damages, in particular for the costs of materials, spare parts, labour, transfer and transport of the products, incurred as a result of the fulfilment of the obligation referred to in the preceding paragraph of this Article.<\/p>\n<p>[\/vc_column_text][vc_separator sep_color=&#8221;color-200521&#8243; uncode_shortcode_id=&#8221;365808&#8243; sep_color_type=&#8221;uncode-palette&#8221;][vc_custom_heading uncode_shortcode_id=&#8221;342160&#8243;]7. The Provider shall endeavour to comply with its obligation to establish an effective system for handling complaints and to designate a person whom the Customer may contact by telephone or e-mail in the event of a problem. Complaints shall be submitted via the e-mail address <a href=\"mailto:tina@artina.si\" target=\"_blank\" rel=\"noopener\">tina@artina.si.<\/a> The complaint handling process is confidential.   <\/p>\n<p>Any disputes between the users and the provider will be settled amicably, but if this is not possible, the court in Ljubljana will have jurisdiction to settle the dispute.
